THOMAS MUSTAIN'S WILL
Dated 6 November 1791; Proved 21 November 1791
In the name of God Amen I Thomas Mustain of the County of Pittsylvani a being weak in body but in my proper senses thanks be to God for th e same, do make and ordain this my last will and testament in manner a nd form as follows- viz
I give unto my beloved wife Mary a sufficient maintainance suitable t o her surcomstance free and undisturbed during her widowhood.
Secondly I give and bequeath unto my son Jesse two hundred acres of la nd to be taken of the upper end of the tract I now live on beginning a t the upper North corner & running down the north line five outs o n ye North line to answer four outs on the south line & so makin g his complement.
Thirdly I leave the balance of the tract of land I live on to be sol d to the highest bidder giving 18 months credit, the purchasers givin g Bond with approved security.
Fourthly I give and bequeath unto my Daughters Rebeckah & Molley t wenty shillings each if the said two daughters are living at the tim e the money becomes due for the sale of the land I have heretofore men tioned, if not their heirs shall have no right to any part of the abov e mentioned legasy.
Fifthly I give unto my two daughters Mary Ann and Salley, ten pounds e ach to be given in the same manner of the Legesys left to Rebeckah an d Molley which monies is to come out of the money arising from the sal e of said land before mentioned.
Sixthly I give andbequeath unto my son Avery Mustain & daughters A nna Bucknor Molley Reese Tabith Bruce Winney Lewis & Saludey Shelt on, an equal part of the money arising from the sale of the above ment ioned land after the money before mentioned is taken out and if eithe r of the last mentioned Legatees should die before the becomes due fo r such land, their heirs shall have no right to any part of my estate.
Seventhly Thomas Mustain son of Jesse Mustain & Jinny his wife pro mises to come and live with me, and use all possible means to suppor t me and my wife during our lives, for which I give and bequeath unt o the said Thomas Mustain a certain tract of land lying on both side s of Nipes Creek in the aforesaid county containing one hundred sevent y acres; also for taking due care of my stock of all kinds, at the exp iration of the above mentioned time, I give to the said Thomas Mustai n one third part of my moveable property, and the balance of my moveab le property, to be equally divided among my six last mentioned childre n.
It is further my desire that my estate may not be appraised, but tha t my executors may pay and receive as far as my estate goes and the la w charges them. I appoint Joel Shelton and my son Jesse Mustain Execut ors to this my last will and testament given under my hand this 6th o f November 1791.

At a court of quarter sessions held for Pittsylvania County the 21st d ay of November 1791. The within last will and Testament of Thomas Must ain deceased was exhibited into Court by the Executors…At a court hel d 20th day of February 1792…Vincent Shelton and Charles Lewis Jr. thei r security granted them for obtaining for obtaining a probate of the s aid will in due form. (D & W Book # 9, page 119).
